The game just changed for cross-border e-commerce. If you are still relying on the old Section 321 "parcelization" playbook to dodge duties, your supply chain is officially at risk.

The Death of De Minimis

As of June 2026, the global suspension of Section 321 de minimis for commercial e-commerce is permanent. Type 86 entries: once the darling of low-value shipping: are functionally obsolete. Every single parcel now requires a full 10-digit HTS classification, a formal entry (Type 01 or 11), and payment of all duties plus a new 10% surcharge. There are no more shortcuts; if it’s commercial B2C, it’s taxable and trackable.

The June 3rd Crackdown

The June 3, 2026 Executive Order, "Strengthening Customs Enforcement," has shifted the burden directly onto the Importer of Record (IOR). CBP now mandates stricter eligibility rules: IORs must maintain significant domestic assets or increased bond coverage. For a 3PL Maryland partner, this means data transparency is non-negotiable. You must now disclose beneficial ownership and detailed production methods for every SKU before it hits the water.

High Stakes and Heavy Penalties

Enforcement is no longer a "slap on the wrist" affair. The new mandate sets a penalty floor of at least 50% of the assessed value for non-compliance. With mitigation for repeat offenders eliminated, a few misclassified HTS codes can bankrupt a margin-thin operation. This is why growing brands are pivoting to structured Mid-Atlantic fulfillment hubs that prioritize compliance over workarounds.
