The U.S. freight downturn has technically ended, but shippers should not expect cheaper transportation. August shipments rose year over year for the first time in 42 months while constrained capacity, elevated diesel, and tighter enforcement continue pushing operating costs higher.

What changed in the U.S. freight market?

August freight shipments increased 2.1% year over year, according to the Cass Freight Index. The recovery remains modest. Supply, not demand, is now the primary constraint.

  • Dry van tender rejections remain near 14%.

  • Diesel has moved above $6.50 per gallon.

  • Spot rates have cooled from summer peaks but remain above 2025 levels.

  • Contract rates are firming, with carriers seeking low-to-mid single-digit increases.

  • Analysts expect capacity pressure to continue into 2027.

What does the EU customs change require?

Regulation (EU) 2026/2108 makes sellers and platforms the “importer for distance sales” for covered e-commerce shipments. Beginning November 1, 2026, businesses must prepare for a permanent Union handling fee and expanded product identifiers in customs declarations.

  • Track merchant and manufacturer identifiers by item.

  • Validate customs data before submission.

  • Review landed-cost models and EU fulfillment workflows.

Why are U.S. compliance risks rising?

ELD enforcement, CDL school closures, broker-liability exposure following the Montgomery ruling, proposed FMCSA action on the drug-possession loophole, the REVOKE Act, and a proposed vessel-cargo mandate could reduce usable capacity and increase documentation risk. CVSA Brake Safety Week ran August 23–29, 2026; fleets should retain inspection and corrective-action records.

Why does trailer-level visibility matter?

Two trailers labeled for Nvidia AI hardware were stolen and found to contain 40,000 pounds of ballast sand. The incident reinforces a practical rule: monitor every trailer, seal, handoff, and exception, not only high-value SKUs.
