What is changing in FMCSA broker transparency?

FMCSA’s supplemental proposal is under OMB review, but no new requirements are in effect.

On August 27, 2026, FMCSA submitted its broker transparency supplemental notice of proposed rulemaking to the White House Office of Management and Budget. The agency restarted the proceeding after shelving its 2024 proposal, which addressed transaction-record access under 49 CFR §371.3.

OMB review can run up to 90 days. FMCSA must publish the supplemental proposal in the Federal Register and open another comment period before any final rule takes effect. Industry expectations: such as electronic records, itemized charges, and 48-hour disclosure: remain proposed concepts, not current compliance duties. What does CBP’s “Flying Trucks” retirement mean?

Express carriers must transition to standard truck manifests by November 24, 2026.

CBP has ended the “Flying Trucks” process, which allowed some truck cargo to move under air-manifest procedures. Carriers must now align cross-border truck movements with standard advance electronic manifest requirements under 19 CFR §123.92.
