Three developments are reshaping freight risk this week: a major detention-fee ruling, tighter scrutiny of chassis access, and new safety and routing tests across global logistics.

What did the D.C. Circuit decide about detention fees?

The D.C. Circuit upheld the Federal Maritime Commission’s position that detention charges must promote freight fluidity. In Evergreen Shipping Agency (America) Corp. v. FMC, the court agreed that fees imposed during a port closure were unreasonable when the trucker had no practical ability to return equipment.

The ruling strengthens shipper protections under the Ocean Shipping Reform Act:

• Carriers must show that charges encouraged timely cargo or equipment movement.

• Fees may be vulnerable when port closures, terminal holds, or other uncontrollable events prevent action.

• Carriers must also follow FMC invoice requirements, including sufficient detail and the 30-day issuance deadline.

Why is the FMC investigating chassis restrictions?

What does South Korea’s Arctic trial mean?

South Korea’s 2,758-TEU PanStar Acro departed Busan on August 22 for a 40–45-day trial through the Northern Sea Route to Felixstowe, Rotterdam, and Gdansk. The route could reduce Asia–Europe distance by roughly 7,000 kilometers, but ice conditions, sanctions, environmental risk, and seasonal access remain significant constraints.
