Freight Pulse & Law Update: Diesel's Record Run, the REVOKE Act Advances, and Expired Food Gets a Fresh Expiration Date
Diesel has reached a record $6.49 per gallon, while tightening truckload capacity and new carrier-compliance pressure are forcing shippers to make decisions earlier.
What is driving the freight squeeze?
National diesel is up roughly 75% year over year. Spot-rate gains are being absorbed by fuel, weakening carrier margins. Tender rejections are hovering around 14.3%, and the capacity exodus remains in its early innings.
Regulatory enforcement, closures of noncompliant driver schools, the Supreme Court’s broker-liability ruling, and increased scrutiny following CVSA Brake Safety Week are pushing shippers toward stricter carrier vetting.

The Strait of Hormuz is carrying about 70% less traffic, triggering reroutes and emergency surcharges. Asia–U.S. container rates are at their highest level since mid-2022. Shippers are responding with:
Minibids instead of annual rate locks
Dedicated fleets for priority lanes
Earlier capacity planning before the 2027 bid season
What does the REVOKE Act change?
H.R. 10237, the REVOKE Act, targets “chameleon carriers” that evade enforcement by reopening under new identities. The bill would require an active USDOT number to operate and allow the Transportation Secretary to immediately inactivate numbers for noncompliance. It is before the House Transportation and Infrastructure Committee, with ATA support.
Separately, FMCSA has paused biennial-update enforcement for due dates on or after June 1, 2026, while Motus stabilizes. That is a paperwork grace window, not a compliance waiver.

What can expired food teach logistics teams?
Authorities in Bengaluru and Navi Mumbai found expired food relabeled with forged dates inside dark-store and packaging operations. The lesson is operational: weak lot controls can turn one mislabeled SKU into a recall, lawsuit, and brand crisis.
