Freight Pulse & Law Update: Diesel Slides for a Third Week, BNSF Expands Overhaul Security, and FMCSA Restores the 30-Day Emergency Window
As of October 14, three developments warrant attention: diesel prices have dipped again, BNSF is expanding intermodal cargo-security coordination, and FMCSA has restored a 30-day automatic regional emergency-relief period.
What does the diesel decline mean for shippers?
The national on-highway diesel average for the week of October 12 was $6.179 per gallon, down two cents for a third straight weekly decline, according to EIA data reported by Logistics Management. Prices remain elevated. The next EIA update is scheduled for October 20.
Fuel surcharge formulas may lag the market. Audit invoice calculations against your contracts and the applicable index before assuming a small decline has reached transportation costs.
How is BNSF changing intermodal security?
BNSF’s expanded exclusive partnership with Overhaul connects real-time risk intelligence with BNSF Police across its 32,500-mile network. The companies say direct integration can flag incidents within seconds, share verified threat signals, and support coordinated multistate responses. Overhaul reports a 99.9% protection rate for monitored shipments.
Intermodal shippers should confirm which lanes and loads have active monitoring, and how incidents are escalated, rather than assume coverage is universal. See BNSF’s announcement.
What changed in FMCSA rules?
Effective October 5, FMCSA changed 49 CFR 390.23(b) from 14 to 30 days for automatic relief following a qualifying regional emergency declaration. Relief applies to eligible direct-assistance operations and may end sooner if the emergency period ends.
A separate five-year exemption, effective October 7, allows eligible Level 4 autonomous trucks to use cab-mounted warning beacons instead of roadside triangles. Key conditions include:
Amber SAE J595 Class 1 beacons with redundant power.
Activation within five minutes of a qualifying stop.
Other Level 4 carriers must give FMCSA prior written notice.
CVSA Brake Safety Week ran August 23–29, focusing on brake drums and rotors. A timely reminder to schedule pre-Q4 maintenance checks.
What should Mid-Atlantic operators prioritize?
For 3PL Maryland and I-95 freight, review fuel surcharge terms, verify rail-security coverage by lane, and document emergency-relief eligibility before dispatch. These checks support more predictable Mid-Atlantic fulfillment and supply chain planning.
