Freight Pulse & Law Update: Flatbed's 40.5 Squeeze, the Broker Insurance Retreat, and the Beef Rib Bandits
Flatbed freight has become the tightest truckload market in the country. At the same time, broker liability exposure is changing insurance capacity, and cargo thieves are targeting everything from beef to copper.
What does DAT’s latest report show?
According to DAT’s Week 38 Truckload Market Report:
Flatbed loads rose 25% week over week to 954,774.
Flatbed equipment posts increased 15%.
The load-to-truck ratio reached 40.5, up from 37.1.
Total equipment posts fell to a record-low 175,593.
Spot rates: van $2.17/mile, reefer $3.59, flatbed $3.55.
Reefer and flatbed capacity are priced like a seller’s market. Lock contract coverage now instead of chasing October spot capacity. As CVSA Brake Safety Week keeps DOT/CVSA brake inspections in focus, verify carrier maintenance records before awarding critical loads.
Why is broker insurance tightening?
Following the Supreme Court’s May 14 ruling in Montgomery v. Caribe Transport II, state-law negligent-hiring claims against brokers can proceed. The Insurer reports that excess and surplus carriers are raising retentions, reducing limits, and adding exclusions. FMCSA’s broker-transparency rule also remains under White House review.
Document authority checks, insurance verification, safety scores, and written qualification standards as if they will be read aloud in a deposition. CRC Group’s analysis explains why.
What can the beef rib theft teach shippers?
FreightWaves reports that masked thieves cut trailer hinges in South Philadelphia and stole roughly half a pallet of Black Angus ribs. Use stronger door hardware, lighting, cameras, and gate verification for protein, electronics, copper, and apparel.
A 24-hour Italian port strike is scheduled for September 28; reroute Europe-origin inbound freight before Golden Week where possible.
FlowOps by Lanta is Lanta’s proprietary, operator-built WMS: built and used daily by Lanta LLC, an operating 3PL. Its 20 modules, patent-pending Agentic AI, unlimited SKUs, and $99/month flat rate give 3PL fulfillment services real-time control. Explore FlowOps or compare plans.
What should you do this week?
Secure flatbed and reefer contracts, refresh carrier-vetting files, and record every appointment, inbound-receiving event, and gate check. Those records show who was vetted and whether a release was authorized, whether you operate 3PL Maryland, Mid-Atlantic fulfillment, or a national supply chain.
