FMCSA has expanded operating flexibility for eligible fuel haulers as diesel prices reach record levels. At the same time, European container rates are falling while trans-Pacific pricing remains elevated, creating a split market for shippers and third party logistics providers.
What does FMCSA’s 16-hour fuel waiver change?
The 90-day waiver took effect September 16 and lets eligible gasoline and diesel haulers operate up to 16 hours in a 24-hour window instead of 14. Drivers still must take required rest breaks, and carriers with conditional safety ratings cannot use it. DOT cited global supply disruptions and diesel prices near $6.29–$6.54 per gallon.

What did PHMSA decide about gasoline hazmat claims?
PHMSA’s Federal Register preemption determination says federal hazardous-materials law and the HMR preempt state common-law tort claims involving gasoline marking, training, loading and unloading, and classification. Federal requirements control those areas. FMCSA also seeks comments on renewing accident-recordkeeping rules, including three-year accident registers, through November 9.

How are container rates splitting by lane?
Asia–Mediterranean rates fell 7% last week to approximately $3,900 per FEU, while Asia–North Europe dropped 15% to about $3,700 as Red Sea transits increase. Trans-Pacific rates moved the other way: West Coast pricing rose 4% above $8,100, and East Coast pricing held near $9,600.
