What did the Axle of Dearborn ruling change?

On Aug. 13, 2026, the U.S. Court of International Trade ruled in Axle of Dearborn, Inc. v. Department of Commerce that the President had authority under IEEPA to suspend the de minimis privilege.

Congress’s statutory repeal still takes effect July 1, 2027. Importers should assume the exemption remains unavailable until then — and permanently after.

How does CBP’s “Detective Border” change enforcement?

CBP has deployed “Detective Border,” an AI enforcement tool designed to flag suspected transshipment before containers clear customs. As reported by TechTimes, the system analyzes:

• Shipment and routing histories

• Exporter and ownership graphs

• Production-capacity patterns

• Manifest data and X-ray imaging

The goal is to identify Chinese goods routed through third countries to evade tariffs, closing the traditional post-audit loophole.

What should importers do before Aug. 23?
