Direct answer: Washington is considering diesel export restrictions and possible red-dyed diesel tax relief, but neither policy is final. Meanwhile, fuel-hauler waivers and state emergency orders are temporarily expanding operating flexibility as diesel reaches approximately $6.57 per gallon.

What changed for fuel haulers?

The FMCSA emergency waiver, effective September 16 through December 16, allows qualifying fuel haulers to operate up to 16 hours in a 24-hour period, up from 14. Texas, Nebraska, Alabama, Louisiana, Tennessee, and Montana also issued orders permitting red-dyed or untaxed diesel in highway vehicles, alongside weight-limit relief for fuel and agricultural transport.

  • All-in spot rates: approximately $3.01 per mile, up $0.02

  • Tender rejections: near 14%

  • ATA August tonnage: down 0.5%

  • Fuel impact: margins are tightening primarily at the fuel line, not from collapsing demand

Refiners warn that an export ban could reduce total domestic supply. Treat the proposal as under review, not enacted. FreightWaves’ market update provides additional rate context.

Which regulatory deadlines matter?

  • UCR fees: Increase 20% on October 1 for the 2027 registration year.

  • USTR port/vessel fees: China-linked suspensions expire November 9 unless extended.

  • REVOKE Act: Still outside committee.

  • FMCSA broker transparency proposal: Still under White House review.

  • CVSA Brake Safety Week: Enforcement continues after the inspection week concludes.
