Freight Pulse & Law: Rates, Rules, and Red Tape in One Read
Freight is getting more expensive: and customs is getting less forgiving. Ocean spot rates have climbed roughly 300% in five months as Red Sea diversions, port congestion, blank sailings, and trans-Pacific peak demand squeeze available capacity. Market coverage shows why importers should expect longer lead times and higher landed costs.
Domestic transportation is tightening, too. Truckload contract rates are up about 18% year over year, while intermodal volumes are posting double-digit growth as shippers shift freight from highways to rail. That shift creates another pressure point: drayage capacity around major terminals remains tight. Reprice contracts, reserve equipment earlier, and compare rail, truck, and gateway options using current data: not last year’s assumptions.

Customs compliance is moving in the same direction. CBP suspended the $800 de minimis exemption for non-postal shipments, with postal entries moving into a separate process. The June policy package also raises the bar for importer-of-record eligibility, including substantive assets, customs bonds, recurring vetting, and better documentation. Importers should map suppliers beyond Tier 1 and maintain evidence addressing forced-labor risks.
The EU is moving toward electronic proofs of origin. U.S. products routed through third countries may require documented proof of direct transport or non-manipulation. Meanwhile, China’s revised Maritime Code, effective May 1, 2026, applies Chinese law to qualifying contracts of carriage involving Chinese ports. Review bills of lading, governing-law clauses, insurance, and claims procedures with counsel. See EU guidance and China maritime analysis.
