Freight Pulse & Law Update - 16:00: 50% Tariffs Hit Canadian Imports as FMCSA Broker Transparency Clears for White House Review
As of August 31, U.S. importers face new exposure on covered Canadian goods, while FMCSA broker-transparency reform has reached White House review. Shippers should update classifications, landed-cost models, and documentation controls now.
What changed for Canadian imports?
The new 50% Section 338 ad valorem tariffs took effect August 22, 2026. CBP’s CSMS #69606660 directs filers to report the applicable Chapter 99 provision alongside the underlying HTSUS classification.
Key actions:
Verify every Canadian-origin SKU against the covered lists.
Check whether Section 232 treatment supports the 9903.03.15 exclusion.
Confirm whether duty drawback applies to re-exported merchandise.
Do not assume USMCA eligibility eliminates the Section 338 duty.
Canada announced dollar-for-dollar retaliation across more than 700 U.S. product categories, reportedly totaling approximately $20 billion, effective September 8. The White House has also threatened 50% tariffs on Canadian autos, parts, and steel beginning January 1, 2027.

What does the FMCSA broker rule mean?
FMCSA submitted broker-transparency rulemaking RIN 2126-AC63 to OIRA on August 27: the first concrete movement in 18 months. The proposal would require brokers to provide electronic transaction records to carriers or shippers within 48 hours of request.
Nothing changes for carriers today. However, OIRA review places a public comment period within reach. FMCSA’s docket remains the authoritative source.
What else should transportation teams monitor?
The Jones Act waiver now runs through November 15, 2026, but its scope is narrowed to 237 HTS codes and requires pre-voyage authorization. The Panama Canal Authority also introduced temporary Neopanamax booking adjustments effective August 30.
