3PL fulfillment services and ecommerce fulfillment face a Sept. 29 deadline. New Section 338 import bans on select Canadian goods move from July’s 50% duties to outright prohibition.

What changes when the Canada Section 338 bans take effect?

At 12:01 a.m. Eastern on Tuesday, Sept. 29, 2026, three presidential proclamations bar covered Canadian alcohol, certain dairy and related goods, and motorcycles over 800cc from entering the U.S. This is the first use of Section 338’s exclusion power in its 96-year history, making date-of-importation control critical.

  • Proclamation 11061: packaged beer, wine, cider, and spirits.

  • Proclamation 11062: dairy, including whey under HTSUS 0404.10, certain molasses, and non-alcoholic beer under HTSUS 2202.91.00.

  • Proclamation 11063: motorcycles with engines over 800cc under HTSUS 8711.50.00.

  • Stage one was the July 20 duty action; stage two is prohibition with no duty workaround.

What should importers and 3PLs do before Sept. 29?

Pre-Sept. 29 imports not yet entered for consumption or withdrawn from warehouse stay on the 50% Section 338 duty, not the ban. If a ban is invalidated, clause 9(b) snaps that import back to 50%.

  • Watch CBP CSMS for implementation guidance and technical corrections.

  • The annexes were scanned Federal Register images, making HTS-line checks harder.

  • Canada’s retaliation under the United States Surtax Order (2026) took effect Sept. 8 at 15%, 25%, or 50%.

What does the current capacity picture mean for fulfillment planning?

Trans-Pacific rates stay elevated on pre-Golden Week demand and capacity management, with about 11% of sailings canceled through late October. Xeneta sees another early-October climb, Asia–Europe softening as capacity recovers, and truckload capacity still historically tight.

  • Use the CVSA 2026 North American Standard Out-of-Service Criteria as the current roadside standard; Brake Safety Week remains part of the annual enforcement calendar.
