Freight Pulse & Law Update: CBP Opens Tariff Refunds Today, Transpacific Rates Peak, and 194,000 Non-Domiciled CDLs at Risk
CBP tariff refund processing is open, transpacific pricing may be topping out, and trucking capacity faces new pressure from non-domiciled CDL enforcement. Importers, carriers, and Mid-Atlantic shippers should tighten documentation, monitor rates, and protect execution now.
What does CBP’s CAPE Phase 3 mean for importers?
CBP opened CAPE Phase 3 on Oct. 6 for certain IEEPA tariff entries liquidated more than 80 days ago. Eligibility requires a Court of International Trade case plus importer-of-record information submitted by July 30, so refunds are not automatic; records must match exactly.
Track liquidation dates and entry numbers.
Open protests, reconciliation, or drawback entries are not eligible yet.

Are ocean and truck rates easing?
Xeneta says US-bound transpacific container rates peaked around Oct. 1, but a steep drop is unlikely if carriers hold the line. Meanwhile, FMCSA’s non-domiciled CDL rule could remove truck capacity even as tender data softens.
Eligibility is limited to H-2A, H-2B, and E-2 visa holders verified through SAVE.
Roughly 194,000 of 200,000 holders may not qualify.
Dry-van spot rates remain elevated year over year.
Which compliance actions matter this week?
Commerce’s temporary anti-stockpiling restrictions cover polysilicon and derivatives through Dec. 3 ahead of Dec. 4 Section 232 measures. Importers need weekly volume controls, while fleet managers should keep the DOT brake-inspection standard aligned with CVSA Brake Safety Week priorities.
