What changed under China’s Maritime Code?

Effective May 1, 2026, Chapter IV mandatorily applies Chinese law to international sea-cargo contracts involving a Chinese loading or discharge port, even when the contract names foreign law. Key changes include:

• The carrier’s fire exemption is narrowed to fires occurring on board.

• Cargo loss is valued primarily at market value at the place and time of delivery.

• Freight forwarders may be treated as shippers for storage and disposal costs involving unclaimed cargo.

• Electronic transport documents can carry the same legal effect as paper when complete, retrievable, and properly authenticated.

Where are freight markets moving?

Freightos FBX data places Asia–US West Coast rates near $7,422/FEU, up 9%, and Asia–US East Coast near $9,422/FEU, up 3%. Asia–Northern Europe has fallen 20% from its July high to approximately $4,700/FEU.

The Panama Canal is cutting two daily transits and reducing Neopanamax draft to 48 feet later in August and 47.5 feet in September. Carrier surcharges range from $200 to $1,000/FEU. Bunker prices are up 15%, with emergency fuel surcharges near $90/FEU expected in mid-September.
