Freight Pulse & Law Update: Congress Weighs a US-Flag Cargo Mandate as Freight Demand Finally Turns Positive

Congress is considering a first-of-its-kind federal requirement for some imported commercial cargo to move on qualifying US-flag vessels. At the same time, freight demand is showing its first year-over-year gain in more than three years: while diesel and capacity costs continue to pressure shippers and carriers.

What would the proposed cargo mandate require?

The House-passed FY 2027 NDAA provision would apply to certain beneficial cargo owners, importers of record, and third-party logistics providers. Covered cargo includes containerized freight and roll-on/roll-off vehicles.

Participation targets would begin at no less than 3% annually for each covered shipper affiliated group and rise in later phases. Covered shippers would certify compliance each year. Failure to meet the target could trigger a civil penalty of at least 10% of covered imported cargo value, excluding cargo that arrived on qualifying US vessels.

The provision remains subject to Senate action and conference negotiations. Scope, targets, vessel standards, and penalty calculations can still change.

Why does the freight market matter now?

Freight demand is improving, but operating conditions remain tight:

  • August Cass Freight Index shipments rose 2.1% year over year, ending 42 consecutive months of declines.

  • Truckload volumes after Labor Day ran about 14% above last year.

  • Diesel jumped 33 cents in one week to $6.26 per gallon.

  • The National Truckload Index slipped to $3.42 per mile, still 47% above last year.

  • Tender rejections remained near 14%, versus 5.5% last year.

Uber Freight warns that late-October demand could produce another Q4 rate surge. CVSA Brake Safety Week also reinforces the need to keep DOT inspection, maintenance, and shipment records organized before peak season.

What should importers and 3PLs do?

Model the proposed 3% target by lane, carrier, and contract. Build an annual certification trail now, and secure Q4 transportation capacity before the market tightens further.
