Diesel climbs as freight capacity tightens

September 16, 2026: Diesel is running near $6.26–$6.31 per gallon, increasing fuel-surcharge pressure and compressing carrier margins. Demand remains muted but is improving, while available truck capacity is tightening on fuel-sensitive and low-density lanes. The EIA diesel benchmark confirms the elevated cost environment.

What changed in shipping law?

  • FMC charge complaints: Effective September 1, shippers may use the no-fee interim charge complaint process or pursue a traditional formal or small-claims complaint. For qualifying demurrage and detention disputes, the carrier bears the burden of proving charge reasonableness. Review the FMC final rule before filing.

  • CBP Form 5106 enforcement: Beginning September 18, CBP may void an Importer of Record number when Form 5106 data is inaccurate, incomplete, or unverifiable. If entry is not filed within 15 days of arrival, cargo may move to General Order. See CBP trade notices.

  • UCR fees: FMCSA’s final rule raises 2027 UCR fees by approximately 20%, effective October 1. See the official fee rule.

  • Proposed import disclosures: CBP is seeking comments on heightened low-value shipment disclosures, with comments due December 1. This is a proposal; not current law.

What should operators do tonight?

  • Shippers and brokers: Verify Form 5106 legal names, addresses, tax IDs, emails, and powers of attorney.

  • Carriers: Reprice fuel exposure, confirm UCR budgets, and protect appointment and delivery records.

  • 3PLs: Preserve invoices, gate records, timestamps, and exception notes for any charge dispute.
