Freight Pulse & Law Update: FMCSA English Rule Sidelines 26K Drivers, CDL Database Fight Heads to Court, FMC Pushes for Antitrust Powers

Three policy fights are putting immediate pressure on trucking and ocean logistics: FMCSA’s proposed English-language proficiency out-of-service rule, a federal court stay blocking DOT and DHS access to CDLIS data, and FMC pressure for stronger authority over ocean carrier agreements.

Shippers, carriers, and third party logistics providers should monitor driver qualification, CDL status, and ocean capacity now before regulatory shifts disrupt the supply chain.

What changed on the trucking side?

FMCSA’s proposal, published as 91 FR 51422, would make English-language proficiency violations under 49 CFR 391.11(b)(2) an immediate out-of-service issue, with limited commercial-zone exceptions. Comments close October 9, 2026. FMCSA says more than 26,000 drivers have already been sidelined, and the agency estimates roughly 9,000 additional annual out-of-service orders plus about $14.4 million in annual costs tied to delay and replacement capacity.

A separate court fight has paused federal access to about 17 million CDL records through CDLIS, with an administrative stay blocking the transfer to DOT and DHS. At the same time, the STOP Improper Licensing Act (H.R. 10123) would require FMCSA to audit how states issue non-domiciled CDLs.

Why does the FMC issue matter?

FMC commissioners are pressing Congress for authority to directly block anticompetitive ocean carrier agreements. That matters after the FMC’s March 2026 World Shipping Council agreement order, which canceled portions tied to competition, antitrust, and policy advocacy while preserving some operational coordination. For importers and supply chain management companies, expanded FMC power could affect vessel capacity, routing, and rates.
