Freight Pulse & Law Update: Hormuz Transits Hit Single Digits, US-China Truce Extended to January, and the Rhine Barge Market Breaks Records

As of September 26, freight markets face simultaneous disruption across ocean, inland waterway, customs, and truckload networks. Hormuz tanker transits have fallen to single digits, Rhine water levels are pushing barge rates toward records, and the US-China truce extension does not yet move key legal deadlines.

What is driving freight costs higher?

Three pressure points deserve immediate attention:

  • Hormuz: Tanker transits have fallen sharply, ship-to-ship transfer capacity near Oman is reportedly full, and VLCC economics have reached roughly $1.27 million per day on risk-loaded routes. Reuters coverage

  • Rhine: Critically low water is forcing barges to sail below capacity, driving freight rates and low-water surcharges toward record territory.

  • Ocean: The Drewry World Container Index slipped 1% to $4,468 per 40-foot container, reflecting weaker Asia-Europe rates but still-elevated global logistics costs.

Did the US-China truce extension change customs law?

No. The Busan Agreement extension reportedly runs through January 10, 2027, but current legal notices still place Section 301 product exclusions and suspended maritime port fees at 11:59 p.m. on November 9, 2026. Importers should not assume diplomacy changes enforceable deadlines.

CBP’s September 22 guidance also gives importers who overpaid qualifying duties from July 1 through September 22 a potential refund path through a post-summary correction or protest. Review entries with trade counsel and monitor formal USTR notices. USTR Section 301 resources

How should shippers manage exposure now?

  • Reprice ocean, barge, fuel, and spot-market assumptions weekly.

  • Treat tender rejections above 14% as a capacity warning.

  • Vet brokers and carriers carefully as new RICO litigation targeting C.H. Robinson and TQL raises broker-risk questions.

  • Prepare for DOT/CVSA inspection readiness following CVSA Brake Safety Week, including maintenance records and driver compliance.
