How does the revised Jones Act waiver affect cargo owners?

The waiver now runs through November 15, 2026, but eligibility is narrower. Only 237 specified HTS codes qualify, and shippers must submit a “VESSEL AVAILABILITY REQUEST” to the Department of War, MARAD, and CBP before sailing. U.S.-flagged domestic operators receive 24 hours to respond.

The IRS ruling also states that waiver-voyage income is not eligible for standard international shipping exemptions. Foreign-flag operators should model the added tax cost and maintain separate voyage records.
