Freight Pulse & Law Update: Record Diesel, a Jones Act Twist, and a Floating Container Mystery

Diesel is pressing toward $5.90 per gallon, while freight surcharges still reflect older benchmarks. At the same time, new FMC complaint pathways, a revised Jones Act waiver, and 47 lost containers are creating fresh compliance and visibility priorities.

Why are fuel surcharges trailing diesel prices?

U.S. diesel reached a record near $5.90/gal on Sept. 7, but many contracts still reference weekly government averages closer to $5.60. That gap shifts immediate cost pressure onto carriers and shippers.

  • Review fuel-surcharge formulas and reset triggers.

  • Separate fuel exposure from base transportation rates.

  • Model the next surcharge increase before approving tenders.

  • Use EIA diesel data as a common reference point.

For growing brands, a 3PL can consolidate transportation, fulfillment, and inventory management for ecommerce while making accessorial costs easier to audit.

What changed for demurrage, detention, and Jones Act shipments?

Effective Sept. 1, the FMC now permits disputed demurrage and detention charges to move through formal complaint or small-claims processes. Document invoices, free-time records, terminal notices, and attempted container returns before escalating through the FMC complaint guidance.

The Jones Act waiver was also extended through Nov. 15, 2026, covering a revised list of 237 products and adding pre-voyage approval. Treat that approval as a shipment-control checkpoint, not a paperwork afterthought.

CVSA Brake Safety Week also makes this a good time to verify DOT brake inspection records across every carrier and subcontractor.

What happened to MV Span Asia 39?

The Philippine-flagged MV Span Asia 39 reportedly lost 46 empty containers off Batangas after rough seas and heavy rolling. A 47th container later went overboard near Manila North Anchorage, while coast guard teams tracked the debris and at least one unit washed ashore. Read the incident report.

What is the weird logistics story?

A robotic “seaglider” is combining hydrofoils, a floating hull, and low-altitude flight for future coastal transport. It sounds unusual, but it points toward a serious supply chain question: how quickly can new equipment reduce short-haul congestion?

Bottom line: Lanta Logistics supports Mid-Atlantic fulfillment from its food-grade warehouse and Hazmat certified 3PL operation in a Glen Burnie warehouse.
