Freight capacity tightened sharply around Labor Day even as demand stayed broadly flat. At the same time, regulators advanced stricter oversight of carriers, brokers, driver-training schools, and vehicle safety.

What is driving the freight market?

The national tender rejection index moved above 14%, marking the tightest Labor Day-period capacity in three years. Contract rates are approximately 18% higher year over year, while flat demand suggests the pressure is coming from constrained capacity: not a broad demand surge. Shippers should tender earlier, protect core lanes, and avoid relying on last-minute spot coverage.

Ocean peak season is also arriving earlier and running shorter than average. Typhoon-related congestion at Chinese ports is colliding with Panama Canal draft restrictions, increasing the risk of rolled cargo, reduced vessel utilization, and schedule changes.

Expert read: Treat this as a volatility and execution problem. A strong transportation plan now requires alternate carriers, earlier bookings, accurate inventory data, and real-time exception management.

Which regulations should carriers watch?

  • FMCSA finalized an approximately 20% increase in 2027 UCR fees, effective October 1, 2026. Review the final rule before registration opens.

  • FMCSA removed more than 110 driver-training schools from its registry and proposed removing 160 more over training and English-proficiency violations. Read the DOT announcement.

  • DOJ’s Crossroads of America task force is targeting trucking fraud, CDL schemes, identity fraud, and illegal operations.

  • FMCSA’s broker-transparency proposal remains under White House OMB review.

What changed in trucking law and safety?

The REVOKE Act (H.R. 10237), introduced September 4 by Reps. Dave Taylor and Shomari Figures, would target “chameleon carriers” operating under inactive USDOT numbers. The proposal has ATA support but remains pending.

CVSA Brake Safety Week ran August 23–29, focusing on brake drums and rotors. Full results are pending. Keep DOT/CVSA brake inspections, maintenance records, and driver checks current.
