As of September 4, 2026, transpacific freight costs are rising while congestion and regulatory scrutiny intensify. Shippers should prepare for higher landed costs, stricter documentation expectations, and greater accountability for demurrage and detention billing.

Why are transpacific freight rates rising?

Late peak-season demand and constrained capacity have pushed spot rates to:

  • Shanghai–Los Angeles: $7,185 per 40-foot container

  • Shanghai–New York: $9,587 per 40-foot container

  • Asia–Europe: Rates are declining as demand softens and capacity expands

The latest Drewry World Container Index reflects a split market: stronger Asia–U.S. demand, but weaker Asia–Europe pricing.

What is driving global shipping risk?

Record port congestion is peaking in North Asia after successive typhoons disrupted Shanghai, Ningbo, and surrounding terminals. Drought-related transit restrictions at the Panama Canal are adding pressure to Asia–U.S. East Coast and Gulf services.

With Red Sea, Black Sea, and Strait of Hormuz crises converging, the current global shipping risk level is 8.3 out of 10. Build buffer into inventory plans, bookings, and customer delivery commitments.

What changed under the FMC’s new charge-complaint rule?

The FMC final rule, effective September 1, standardizes Charge Complaint procedures under the Ocean Shipping Reform Act of 2022. When a demurrage or detention dispute proceeds as a traditional complaint, the carrier must prove that the charges are reasonable.

Review contracts now. Clearly assign billing liability, free-time responsibilities, appointment obligations, and documentation duties.

What should importers and carriers do next?

CBP’s September 2 ANPRM on heightened import disclosures is not yet a binding requirement, but it signals stronger future expectations for exporter records, identifiers, ownership data, and supply chain traceability.
