The August 17 Jones Act waiver extension narrows eligible cargo to 237 HTS codes and adds voyage-specific vessel availability procedures. On September 3, HM-268 hazmat rules change aerosol definitions, expand lithium battery materials-of-trade relief, and authorize electronic documentation and payments. Importers must update classifications, approvals, and operating records now.

What changes under the Jones Act waiver?

The waiver runs August 17–November 15, 2026. Before using foreign-flag tonnage, shippers must submit a Vessel Availability Request to the Department of War, MARAD, and CBP.

  • Confirm the product’s HTS code appears on the 237-code list.

  • Provide vessel, ownership, voyage, port, cargo, and national-defense information.

  • Secure MARAD’s availability review and the Department of War’s determination.

  • Load qualifying cargo by November 15.

Review MARAD domestic-shipping resources before booking.

What does HM-268 change on September 3?

PHMSA’s finalized HM-268 series modernizes hazmat operations:

  • Aerosols may contain gas-only contents under the revised definition.

  • Materials-of-trade relief expands for lithium batteries.

  • Emergency response information may be maintained electronically.

  • Hazmat registration and payments move to electronic submission.

  • Carriers may carry registration certificates electronically.

A Hazmat certified 3PL should update SOPs, training, document-access controls, and inspection procedures before the effective date. DOT brake check inspections and safety blitzes add another reason to verify carrier equipment, driver records, and shipment documentation.

How should importers prepare for tariffs and forced-labor enforcement?

New Section 301 tariffs replace the expiring Section 122 surcharge with country-specific rates. Separately, 43 entities were added to the UFLPA list, increasing supplier-screening and admissibility risk. Recheck country of origin, HTS classifications, landed cost, and supplier documentation.
