Freight Pulse & Law Update - 20:00: Peak Surge Missing, Transpacific Rates Climb, Tariff Risk Escalates

Peak season has not produced the expected early-September truckload surge. Domestic rates remain relatively restrained while ocean carriers push transpacific pricing higher and tariff exposure expands across the U.S.–Canada trade lane.

Why is the domestic peak surge still missing?

Early-September spot van, reefer, and flatbed rates have firmed only modestly. Truck capacity temporarily contracted by roughly 10% during CVSA Brake Safety Week, but that short-lived reduction has not overcome broader capacity availability. Higher diesel prices are raising all-in transportation costs without creating a comparable linehaul spike.

  • Watch fuel surcharges separately from linehaul rates.

  • Expect localized pressure, not a national truckload shock.

  • Recheck carrier availability after inspection activity.

Why are transpacific rates still elevated?

Transpacific spot rates remain near $7,000–$8,000 per FEU to the U.S. West Coast and $10,000–$11,000 to the East Coast. Carriers have successfully advanced general rate increases, keeping import costs elevated even as the traditional peak-season surge remains muted inland.

What should shippers verify before September 8?

The United States has activated 50% tariffs on approximately $20 billion of Canadian goods. Canada’s counter-tariffs begin at 12:01 a.m. on September 8, with 15%, 25%, and 50% rates. Confirm every SKU’s origin, HTS classification, and entry timing; routing through a third country does not change origin.

  • Map affected SKUs to the official Canada tariff list.

  • Recheck USMCA treatment; it may not shield covered products.

  • Validate customs documents before loading.

What changed in federal freight law?

FMCSA sent its broker-transparency supplemental proposal to OMB on August 27. The expected rule would require automatic transaction records and prohibit waiver clauses, but it is not yet final. Separately, NHTSA says it lacks authority to set standalone truck-engine fuel-economy standards and has aligned enforcement with that interpretation pending rulemaking.
