Freight Pulse & Law Update - 20:00: Trans-Pacific Rates Rise as Compliance Deadlines Tighten

Trans-Pacific ocean rates are rising as resilient U.S. import demand meets Shanghai congestion, Panama Canal constraints, carrier capacity management, and new surcharges. Asia-Europe rates are weakening as Suez transits gradually recover, but network reliability remains uneven.

Why are trans-Pacific rates rising?

Carriers are protecting pricing through blank sailings, tighter capacity, and surcharge programs. Congestion around Shanghai is reducing effective vessel availability, while Panama Canal restrictions continue to pressure Asia–U.S. East Coast services. Shippers should book capacity early, model surcharges into landed cost, diversify gateways and modes, and maintain shipment-level visibility.

What changed under the FMC’s September 1 rule?

The Federal Maritime Commission’s Charge Complaint Procedures clarify that qualifying charge complaints may proceed through traditional processes before an Administrative Law Judge or Small Claims Officer: not only through the interim procedure. For demurrage and detention disputes, applicable burden-shifting rules matter: the carrier may bear responsibility for establishing charge reasonableness. Preserve appointment records, terminal availability notices, free-time terms, bills of lading, and invoices.

What should importers and fleets do now?

CBP is emphasizing accurate, current importer-of-record information, including Form 5106 data. Review legal names, tax identifiers, addresses, phone numbers, and email records with your customs broker; do not assume an unverified final rule has been issued.

The August 23–29 CVSA Brake Safety Week focused on brake drums and rotors. Continue DOT/CVSA roadside readiness: inspect equipment, document defects, and correct issues before dispatch. Recent CVSA inspection results show why brake systems and cargo securement require consistent controls.

Key takeaways

  • Book ocean capacity before peak-season tightening.

  • Model canal, congestion, and carrier surcharges.

  • Keep charge-dispute and customs records audit-ready.

  • Use a WMS and logistics software for visibility.
