Freight Pulse & Law Update: The 2027 Engine Rule Is Still Unwritten While Spot Rates Sit Flat for a Second Week
The EPA’s rewrite of the 2027 engine rule is still unfinished, and truckload spot rates barely moved for a second week. One is a 2027 cost risk; the other is a plateau, not a turn.
Is the 2027 Engine Rule Final Yet?
No. The July amendment package is still a proposal with no final date, while the 0.035 g/hp-hr NOx standard, an 85% cut from today’s 0.2 limit, takes effect January 1, 2027 as written. (EPA rulemaking)
EPA held hearings in late July and closed comments August 29.
The proposal would cut the 10-year/450,000-mile emissions warranty, push useful-life rules to 2030, and swap DEF derates for dashboard warnings.
Daimler says it certifies to the rules on the books and starts Detroit Gen 6 DD13 and DD15 production in January.
FTR estimates nonconformance penalties pass through at $6,000–$7,000 a truck, against an $8,000–$12,000 upcharge for compliant engines. 2026 build slots are sold out.
So ask carriers what powertrain they're ordering before you quote 2027 rates, and treat warranty terms as negotiable.
Are Truckload Spot Rates Turning?
No. The total market broker-posted rate fell three-tenths of a cent last week, and DAT’s linehaul averages moved a penny or less by equipment type. (FleetOwner; DAT data)
Dry van $2.26 a mile, reefer $2.76, flatbed $2.65 (DAT).
Year over year, FTR has dry van up nearly 47%, reefer 44% and flatbed 43%.
FTR loads: dry van up 1%, reefer up 3%, flatbed down almost 4%.
DAT spot load postings fell 5%.
The mix is the story. Dry van and reefer usually split this week and flatbed dips. All three barely moved, which is constrained carrier supply holding a seasonal plateau.
What Does This Mean for the I-95 Corridor?
For Baltimore, Seagirt, Glen Burnie and I-95 into New England, national averages are not corridor forecasts. Neither item guarantees a local rate move, so price the lane, not the index.
