Freight Pulse & Law Update: IRS Pauses Dyed Diesel Penalties but Not the Tax, and States Aren't Following

A paused penalty isn’t a free tank: federal tax remains, and states set their own rules.

What paused?

On Oct. 14, the IRS paused penalties and ordinary collection and enforcement, reassigned fuel-compliance officers, and halted federal inspections for dyed diesel sold for highway use or used on highways, Oct. 1–Dec. 31, 2026. Section 4041(a) tax remains: retail sellers generally owe it, or vehicle operators for farm-tank fuel. Only Congress can repeal this statutory tax.

• No federal dyed-diesel inspections during the period.

• Keep records to calculate tax owed.

• Residual-dye mitigation is under consideration.

What did IR-2026-125 add?

The Oct. 21 IRS notice, IR-2026-125, adds temporary relief: the IRS will not challenge filing, reporting or recordkeeping failures solely tied to section 4041(a) tax on taxable Oct. 1–Dec. 31, 2026, uses, including Form 720 filed only for that liability. No civil penalties or additions to tax apply. Later deadlines are covered; no reconstruction is required. Other Form 720 liabilities still require filing and records.

Do state rules change?

No. Federal relief leaves state fuel-tax and recordkeeping rules untouched. Illinois still requires four years of records under its own guidance. Keep underlying-tax records and check state rules separately. Interest on tax due was not addressed, Transport Topics reports.
