Freight Pulse & Law Update: DOT CVSA Brake Safety Blitzes and Port Tariff Enforcement
Yes: August’s key freight compliance date is approaching. CVSA Brake Safety Week runs August 23–29, 2026, with inspectors applying the current North American Standard Out-of-Service Criteria to commercial vehicles across the United States, Canada, and Mexico.
What brake check requirements apply in August 2026?
The 2026 criteria are already in effect and replace prior versions. Inspectors will conduct brake-focused and full roadside inspections, with special attention this year to brake drums and air-disc rotors.
Key requirements include:
20% defective-brake threshold: A vehicle may be placed out of service when at least 20% of its service brakes are defective.
Drum and rotor condition: Inspectors will look for cracks, severe corrosion, deep grooves, heat damage, and excessive wear.
Brake lining thickness: The 2026 criteria align hydraulic and electric brake measurements with a 1/16-inch minimum.
Air systems: Check hoses, tubing, service air connections, leaks, pushrod stroke, slack adjusters, and warning indicators.
Review the CVSA 2026 Out-of-Service Criteria and Brake Safety Week focus guidance before dispatching equipment.

How does port tariff enforcement affect drayage?
CVSA does not create a separate brake rule for container ports. However, drayage tractors and chassis entering marine terminals remain subject to the same DOT, FMCSA, and CVSA standards. A failed inspection can trigger an out-of-service order, gate refusal, missed appointments, storage exposure, or terminal charges under local tariffs and gate rules.
Review each terminal’s current requirements. Keep annual inspection records, maintenance documentation, and pre-trip checklists accessible. Inspect chassis brakes as carefully as tractor brakes.
What should shippers do now?
Ask carriers and third party logistics providers to confirm equipment readiness before the blitz. Strong inventory management for ecommerce and a reliable warehouse management system also help prevent port delays from disrupting fulfillment.
