Fuel-hauling rules have loosened temporarily, while ocean and rail networks are tightening. Shippers should prepare for higher transportation costs, longer lead times, and more complex routing decisions through Q4.

What changed under the FMCSA fuel-hauler waiver?

The FMCSA emergency waiver, effective September 16 through December 16, 2026, allows eligible drivers hauling gasoline and diesel to operate up to 16 hours in a 24-hour period when required rest breaks are taken.

The waiver responds to diesel prices near the 2026 high of approximately $6.29 per gallon.

  • Applies to qualifying interstate fuel haulers in good standing.

  • Required rest periods remain mandatory.

  • Fatigued drivers must stop.

  • Carriers must report qualifying crashes to FMCSA within two business days.

This is temporary relief, not a permanent change to hours-of-service requirements. During CVSA Brake Safety Week, carriers should treat the extended operating window as a compliance responsibility, not a productivity target.

Why are ocean and rail conditions tightening?

FlowOps by Lanta dashboard showing real-time logistics activity

The Panama Canal is limiting daily transits to 32, while Asian port backlogs and Golden Week blank sailings are reducing available capacity. Transpacific spot rates have exceeded $10,000 per 40-foot container, according to market reporting.

At Los Angeles–Long Beach, rail-bound container dwell reached 6.75 days in August, up 36% year over year. The AAR’s latest weekly data also shows year-over-year declines in U.S. carload and intermodal volume.

What should shippers do now?

  • Book constrained ocean capacity earlier and model alternate gateways.

  • Add inventory buffers for rail-dependent freight.

  • Track dwell, appointment, and delivery exceptions in one system.

  • Review carrier compliance before relying on extended HOS flexibility.
