Freight Pulse & Law Update: LTL Rates Hit an 8-Year High, the English-Language Rule Draws Fire, and Pilot-Tesla Opens the First Megacharger
LTL costs are climbing, a proposed roadside rule faces scrutiny, and electric freight gains a new charging stop. Shippers should review Q4 exposure and keep plans flexible as regulations and infrastructure evolve.
What is driving LTL rates higher?
The TD Cowen-AFS Freight Index ended Q3 with its LTL rate-per-pound measure 78.8% above its January 2018 baseline, an eight-year high. The index projects 82.5% above baseline in Q4, increasing cost pressure for shippers replenishing through less-than-truckload networks this holiday quarter.
Q3 result: 78.8% above the January 2018 baseline. (FreightWaves)
Q4 projection: 82.5%. Audit freight classifications and accessorial charges now.
What is changing in FMCSA’s English-language proposal?
FMCSA’s proposal to make English-language proficiency violations an out-of-service offense closed for public comment on October 9, 2026. Industry and civil-rights stakeholders support the safety objective but challenge the absence of standardized assessments and warn that subjective roadside decisions could invite discriminatory enforcement.
FMCSA separately placed 78 drivers out of service across four states, according to DISA Global Solutions.
CVSA Brake Safety Week ran August 23–29, 2026, underscoring how quickly an out-of-service finding can sideline a truck and its freight.

Where did Pilot and Tesla open their first Megacharger?
Pilot and Tesla opened their first heavy-duty Megacharger site in Ellabell, Georgia, while 12 additional locations are under construction in California, Texas and Nevada. The opening gives carriers a real charging stop to factor into electric drayage and regional-route plans as charging infrastructure follows freight lanes.
The site features six charging stalls delivering up to 1.2 megawatts: a Tesla Semi recovers 60% of its charge in 30 minutes. (Pilot announcement)
What’s moving in the Mid-Atlantic?
Port of Baltimore activity is expanding as Seagirt’s intermodal container-transfer expansion and grain transloading capacity come online, with rail shipments beginning this fall. A southeast Baltimore warehouse fire on October 15 caused local traffic delays, reinforcing the need to protect inventory plans from access disruptions.
Brands using third party logistics providers in Maryland should build detours into dock appointments and communicate schedule changes.
