Capacity, compliance, and maritime security are tightening simultaneously: logistics professionals face higher Panama Canal costs, stricter Jones Act approvals, stronger detention-fee scrutiny, and escalating Black Sea risk.
What is changing in freight law and capacity?
Panama Canal: The Panama Canal Authority will reduce daily capacity to 34 transits beginning September 3: nine Neopanamax and 25 Panamax. On September 15, the cap falls to 32 vessels, with only 23 Panamax slots. One vessel recently paid a record $5.3 million for an auction slot as bidding surged to several times normal levels. Shippers without reservations should expect longer waits, higher premiums, or alternate routing.
Jones Act: The U.S. waiver now runs through November 15, 2026, but the framework effective August 17 is narrower. Eligible products reportedly fell from more than 600 to 237 categories, primarily petroleum, LNG, and specific fertilizers. There is no blanket exemption. Each voyage requires a Vessel Availability Request to the Department of War, MARAD, and CBP. MARAD then conducts a market survey: reported at 24 hours to prioritize available U.S.-flag coastwise vessels.
FMC ruling: In Evergreen Shipping Agency (America) Corp. v. FMC, the D.C. Circuit unanimously upheld the FMC’s freight-fluidity standard. Detention fees charged during a port closure can be unreasonable when truckers cannot return equipment. If carriers characterize charges as compensation, they bear the burden of showing that fees reflect actual costs.
Black Sea and road safety: Turkish shipowners warn that escalating attacks could push vulnerable operators toward insolvency; reporting attributes more than 70% of wartime commercial-vessel attacks to 2026. Separately, DOT-linked CVSA Brake Safety Week runs August 23–29, making fleet inspections and maintenance records essential.
