Freight Pulse & Law Update: Panama Canal Cuts, Hormuz Standoff, and the De Minimis Era Ends

Peak season is tightening transpacific capacity just as drought, geopolitical risk, and customs enforcement add new cost and compliance pressure.

Why are transpacific freight costs rising?

Asia–U.S. container rates are climbing as demand meets blank sailings and reduced Panama Canal capacity. The canal will limit daily transits to 34 in September, then reduce the cap to 32 after September 15 as El Niño-driven drought lowers water levels. Carriers are adding surcharges to Asia–U.S. East Coast and Gulf services.

  • Budget for peak-season and Panama Canal surcharges.

  • Book Asia–U.S. East Coast and Gulf cargo early.

  • Expect longer lead times where capacity is shifted or vessels are rerouted.

The Strait of Hormuz remains closed to normal commercial traffic. Many Asia–Europe services continue routing around the Cape of Good Hope, while select carriers cautiously resume Red Sea transits. Arctic alternatives are also moving from concept to trial: South Korea launched its first Arctic container voyage, and a Chinese vessel delivered roughly 500 containers to Murmansk via the Northern Sea Route (South Korea’s trial, Murmansk call).

What changed under the Jones Act waiver?

The waiver now runs August 17–November 15, 2026, applies voyage by voyage, and reportedly covers 237 HTS codes. Shippers seeking foreign-flag capacity must submit a Vessel Availability Request to MARAD, with U.S.-flag vessels prioritized.

The U.S. Court of International Trade also confirmed that the President may eliminate the duty-free de minimis exemption for goods under $800. Importers should now assume duties, formal entry requirements, and greater scrutiny. AI-assisted customs analysis will increasingly flag undervaluation, misclassification, and transshipment patterns.

What should shippers do now?

Recalculate landed costs, validate HTS classifications, document origin, and maintain routing alternatives. During CVSA Brake Safety Week from August 23–29, verify carriers, brake records, and delivery schedules.
