Freight Pulse & Law Update: Tariffs, De Minimis and Hazmat Rules Reshape August Freight Planning
As of August 15, 2026, importers and freight operators face overlapping tariff, forced-labor, hazmat, maritime, and carrier-registration changes. Treat compliance as an operating requirement: not a paperwork exercise.
What changed in trade policy?
A new Section 301 framework reportedly applies additional duties of 10% or 12.5% after July 24. Litigation is pending, so importers should model multiple landed-cost scenarios and preserve classification, origin, and valuation records.
The U.S. Court of International Trade also upheld elimination of the $800 de minimis exemption. Low-value e-commerce shipments now require more disciplined entry, duty, and documentation planning.
On August 3, DHS added 43 entities to the UFLPA Entity List. Screen suppliers, subcomponents, and origin claims before cargo reaches the port.
Which transportation rules require action?
The Jones Act waiver now runs through November 15. Beginning August 17, foreign-flag movements require a voyage-by-voyage Vessel Availability Request, giving U.S.-flag operators an opportunity to provide capacity.
PHMSA HM-268 rules are mostly effective September 3. Covered operations may use electronic emergency-response information and registration documents, while registration fees move to electronic payment. Maintain offline access and inspection-ready backups.
The DOJ/DHS trade-fraud guidance raises False Claims Act exposure for undervaluation, false origin, misclassification, and tariff evasion. Third party logistics providers and brokers should document escalation and audit procedures.
How should shippers and carriers prepare?
FMCSA’s MOTUS registration platform continues to produce technical and status-reporting problems. Verify insurance, authority, and USDOT records, retain support tickets, and prepare for DOT brake-check inspections and safety blitzes. Mechanical defects remain enforceable regardless of registration-system relief.
