Freight Pulse & Law Update: Trans-Pacific Rates Hit a Year High, a Fuel Waiver Runs to December, and Customs Loopholes Face a Fast Track

Trans-Pacific spot rates are climbing again, but ocean freight is not the only Q4 budget risk. Shippers also face tighter inland capacity, temporary fuel-hauling relief, and faster customs scrutiny.

Why are inland costs becoming the real Q4 risk?

Asia–U.S. spot rates are about $8,400 per FEU to the West Coast and $9,600 per FEU to the East Coast, according to FreightWaves reporting. Capacity controls and congestion are keeping pricing elevated.

The bigger pressure point is inland:

  • Drayage and wait times

  • Chassis and street dwell

  • West Coast rail capacity

  • Transload and warehouse space

  • Detention, demurrage, storage

What do the fuel and customs updates mean?

FMCSA’s emergency waiver gives eligible interstate gasoline and diesel haulers added HOS flexibility through December 16, 2026. A 16-hour driving limit still applies.

At the same time, the White House and CBP are tightening scrutiny on low-value entries. The CBP proposal targets de minimis-style abuse tied to Section 201, 232, and 301 goods. Expect tighter HTS classification and entry documentation.

Do not treat the U.S.–China truce as a full legal reset. The truce runs to January 10, 2027, but Section 301 exclusions and the China-linked port-fee pause still expire November 9, 2026 unless USTR extends them.

What should logistics managers do now?

  1. Lock drayage, chassis, rail, and warehouse capacity before Q4 congestion builds.

  2. Re-price landed-cost models around inland charges, not ocean rates alone.

  3. Audit HTS codes, country-of-origin records, commercial invoices, and broker instructions.

  4. Track CVSA Brake Safety Week results from August 23–29, 2026, and keep DOT brake inspections current.
