Freight Pulse & Law Update: FMCSA Restores 30-Day Emergency HOS Relief, Intermodal Becomes the Capacity Escape Valve, and Canada's Surtax Rewrites Border Paperwork
FMCSA restored 30-day emergency HOS relief as tight truckload capacity pushes more freight toward intermodal. At the Canadian border, surtax enforcement makes origin records and timestamps critical.
What does FMCSA’s 30-day emergency HOS rule change?
Effective October 5, FMCSA restored the automatic emergency-exemption period in 49 CFR 390.23(b) from 14 to 30 days after a qualifying regional declaration by a Governor or FMCSA. Thirty days is a maximum: relief ends sooner if the declaration expires or direct assistance ends, and FMCSA may extend it under 49 CFR 390.25.
Confirm the declaration, covered operations and end date before dispatch.
Do not treat the change as a blanket HOS waiver.
Why are shippers turning to intermodal?
Truckload contract rates are at a 52-week high and tender rejections are near 14%, so shippers are moving suitable long-haul freight to domestic intermodal. Compare transit time, terminal access, chassis availability and total lane cost before converting loads.

What should carriers check on Canada-bound freight?
Canada’s surtax took effect September 8 at 15%, 25% or 50% on covered U.S.-origin goods. Origin, not routing, controls applicability, and in-transit exclusions require supporting records such as bills of lading and cargo control documents. Audit timestamps and shipment details now to reduce border delays and disputes.
What does this mean for I-95 operations?
Maryland to New England: At Baltimore/Seagirt, verify drayage appointments and container documents. Check handoffs and dwell in Philadelphia, New York/New Jersey and Boston. Review tolls, permits and lane costs across MD, DE, PA, NJ, NY, CT, RI and MA.
CVSA Brake Safety Week ran August 23–29, 2026, with a focus on drums and rotors. Keep brake inspections and maintenance records current for roadside readiness.
