Freight Pulse & Law Update: Rates Dip, Panama Capacity Tightens, and FMCSA Broker Rules Advance

As of August 29, 2026, freight costs are easing slightly, but operational and regulatory risks are increasing. Shippers should plan for tighter Panama Canal capacity, severe Shanghai congestion, evolving FMCSA requirements, and active FMC enforcement.

What is happening in ocean freight?

The Drewry World Container Index fell 1% to $4,473 per 40-foot container. However, Shanghai vessel waits surged to approximately 96 hours, compared with 35 hours the prior week.

The Panama Canal will also reduce planned daily capacity from 36 to 34 transits on September 3 and 32 on September 15, subject to operational changes. Expect longer lead times, possible blank sailings, reduced vessel intake, and additional surcharges. Review the Panama capacity analysis.

Which freight laws and rules should teams monitor?

FMCSA has sent its broker-transparency proposal to OIRA for review. It is not yet effective. Do not change contractual or disclosure procedures until a final rule is published and implemented. Monitor the FMCSA proposal update.

• Audit broker transaction records and retain rate, payment, and access documentation.

• Review demurrage and detention invoices for container numbers, bill of lading data, free-time dates, billed dates, rates, and dispute instructions.

• Challenge charges that do not support freight fluidity, consistent with the FMC’s court-backed position.

• Complete brake inspections during the DOT/CVSA Brake Safety Week window, focusing on drums, rotors, air leaks, adjustment, and DVIR records.
